These terms govern your use of thesunseen.com (the "Site") and any purchase you make. The Site is operated by Visual Freedoms LLC, trading as Sunseen ("we", "us", "our"). By using the Site or placing an order, you accept these terms. Nothing in these terms removes or limits your mandatory rights as a consumer under the law of your country of residence.
The Site is free to access for anyone with an internet connection; your access costs (device, connection) are your own. The Site is normally available at all times, except during maintenance or events beyond our control, and we are not liable for any interruption.
Some features may require an account. You agree to give accurate information and to keep your login details confidential. Activity carried out from your account is treated as yours.
We take care to describe our products accurately, but small variations in colour and detail can occur. Prices are shown in GBP and include applicable taxes where required. We may correct any obvious errors in price or description, and prices may change, but your order is charged at the price shown when you ordered.
Placing an order is an offer to buy. Payment is due at the time of order through our secure payment providers. A contract is formed when we send you an email confirming dispatch. If we cannot fulfil an order, we will tell you and refund any payment.
Delivery is covered by our Shipping policy. Risk of loss or damage passes to you when you, or someone you have nominated, take physical possession of the goods.
Your cancellation, return and refund rights are set out in our Returns and Refunds policy, including the UK 14-day right to cancel and our 30-day free returns.
For consumers in the United Kingdom, the Consumer Rights Act 2015 gives you the right to goods that are of satisfactory quality, fit for purpose and as described. If they are not, you have a short-term right to reject within 30 days, and otherwise a right to repair or replacement and, where appropriate, a price reduction or final right to reject. These rights are in addition to our returns policy.
If you post content such as a review, you grant us a non-exclusive, royalty-free, worldwide licence to use it in connection with the Site. You agree not to post anything unlawful, defamatory, offensive or infringing the rights of others.
All content on the Site, including the Sunseen name, logo, trade marks, text, graphics and images, belongs to Visual Freedoms LLC or its licensors and may not be used without our written permission.
The Site may link to third-party sites. We do not control them and are not responsible for their content.
We do not exclude or limit our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, for fraud, or for your statutory rights as a consumer. We are not liable for problems caused by the internet (outages, intrusion, viruses) outside our control, nor for losses that were not foreseeable.
Wherever you live, you keep the mandatory consumer protections of your country, and you may bring proceedings in your local courts.
These terms are governed by the law of England and Wales, but this does not deprive you of the mandatory consumer protections available to you under the law of your country of residence.
The processing of your personal data is governed by our Privacy Policy.
