1. Who we are

Sunseen is a trading name of Visual Freedoms LLC. We are the data controller for your personal data, in line with the UK GDPR and the Data Protection Act 2018, and we respect the privacy laws of the other countries we serve.

2. What we collect and why

  • To process your order (legal basis: performance of our contract): name, delivery and billing address, email, phone where provided, and order details. Used to register you as a customer, prepare and ship your order, and keep you informed.
  • To support you (legal basis: contract and our legitimate interests): name, email, order history and the content of your messages. Used to answer questions and resolve any issues.
  • To send marketing (legal basis: consent): email, first name and purchase history. With your consent, used to send our newsletter, offers and news. You can withdraw consent at any time.

We do not knowingly collect data from children under 13 without the consent of a person with parental responsibility.

3. Cookies

Our site uses cookies to work properly and improve your experience:

  • Essential cookies: needed for the site and checkout (Shopify session, basket). These cannot be switched off.
  • Analytics cookies: help us understand how visitors use the site. Set only with your consent.
  • Marketing cookies: used to show you relevant ads. Set only with your consent.

You can manage your choices at any time through the consent banner shown on your first visit.

4. Who we share your data with

We share data only where needed to serve you, with providers held to the same confidentiality:

  • Payment providers (such as Shopify Payments and other card processors) to take your payment securely.
  • Delivery carriers to bring your parcel to you.
  • Shopify Inc., which hosts our store and stores your order data.
  • Email and marketing tools to send our newsletter, if you have consented.

We never sell your personal data.

5. International transfers

As Visual Freedoms LLC is based in the United States, your data may be processed outside the United Kingdom, including in the United States. Where this happens, we rely on appropriate safeguards, such as the UK International Data Transfer Agreement (IDTA) or the UK Addendum to the EU Standard Contractual Clauses, and, where it applies, the UK Extension to the EU-US Data Privacy Framework.

6. How long we keep your data

  • Order and transaction records: kept for 6 years to meet UK tax and accounting obligations.
  • Support data: kept only as long as needed to handle your request.
  • Marketing data: until you unsubscribe (a link is in every email).

7. Security

We take security seriously and use technical and organisational measures, including SSL/TLS encryption, to protect your information against unauthorised access, loss or alteration.

8. Your rights (United Kingdom and EU)

Under UK and EU data protection law you have the right to access, correct, erase, restrict or object to the processing of your data, to data portability, and to withdraw consent. To exercise any right, email support@thesunseen.com. We will respond within one month. You also have the right to complain to the Information Commissioner's Office (ICO) at ico.org.uk.

9. Your rights in the United States (including California)

If you are a resident of the United States, you may have rights under your state privacy law, including, in California, under the CCPA as amended by the CPRA. These can include the right to know what personal information we hold, to delete it, to correct it, to opt out of the sale or sharing of your personal information, to limit the use of sensitive information, and not to be treated differently for exercising your rights. We do not sell your personal information for money. We may share limited information with advertising partners through cookies for targeted advertising, which California treats as "sharing"; you can opt out at any time through our cookie settings, by emailing support@thesunseen.com, or by using a Global Privacy Control (GPC) signal, which we honour. Residents of other US states with privacy laws (such as Virginia, Colorado and Connecticut) have similar rights and can contact us the same way.

10. Your rights in Australia

If you are in Australia, the Australian Privacy Principles may apply to how we handle your personal information. You can ask us to access or correct your data by emailing support@thesunseen.com. We may disclose your data to overseas recipients, including in the United States (see International transfers). If you believe we have breached the Australian Privacy Principles, you can complain to us first, and then to the Office of the Australian Information Commissioner (oaic.gov.au).

11. Your rights in New Zealand

If you are in New Zealand, the Privacy Act 2020 applies. You can ask us to access or correct your data by emailing support@thesunseen.com. We may disclose your data overseas, including to the United States, with appropriate safeguards. You can raise a concern with us, and then with the Office of the Privacy Commissioner (privacy.org.nz).

12. Your rights in Canada

If you are in Canada, you have rights under PIPEDA and, in Quebec, under Law 25, including the right to access and correct your personal information. To exercise them, email support@thesunseen.com. You can also complain to the Office of the Privacy Commissioner of Canada (priv.gc.ca). For marketing emails to Canadian recipients, we rely on your express consent in line with Canada's Anti-Spam Legislation (CASL), we identify ourselves, and we include an unsubscribe link in every message.

13. Changes

We may update this policy from time to time. The latest version will always be on this page with its update date.
